These Terms and Conditions („Terms”) constitute a legally binding agreement between the Photographer („Photographer,” „we,” „us,” or „our”) and the Client („Client,” „you,” or „your”) for the provision of photography and videography services in Zanzibar. By booking our services, you agree to be bound by these Terms. Please read them carefully.

The Client confirms that he has read, understood, and accepted all the terms and conditions outlined herein. The Client acknowledges that his acceptance of these terms is a prerequisite for the provision of photography services by the Photographer. Failure to adhere to these terms may result in the cancellation of the booking or additional charges as deemed appropriate by the Photographer. Any amendments or deviations from these terms must be agreed upon in writing by both parties.

1. Booking and Payment: 
To secure a booking, a non-refundable deposit-reservation fee of 200USD is required. For bookings that involve additional services, such as boat rides, horse shoots, or access to private locations, applicable deposit fees will be calculated individually and communicated to the client at the time of booking.This reservation fee guarantees your booking and will be deducted from the final price of the photoshoot. In the event of cancellation by the Client, the reservation fee will not be refunded.  Failure to pay the reservation fee by the specified deadline (2 days)  may result in the forfeiture of the booking slot. 
Full payment must be made on the day of the photoshoot by cash, Paypal, Revolut or bank transfer. All photos, films, and other materials will remain the property of the photographer and will not be delivered to the client until full payment has been received. No partial files or previews constitute delivery, and access to any online galleries or download links will only be granted once the full payment is completed.

2. Cancellation Policy: 
Cancellations made by the Client less than 48 hours before the scheduled photoshoot may result in forfeiture of the deposit. If the Photographer needs to cancel due to unforeseen circumstances, a full refund or rescheduling option will be provided.
We do our best to create beautiful photos and films, but we have no control over the weather in Zanzibar. While sunny and clear conditions are ideal for a photoshoot, cloudy or overcast weather does not constitute a valid reason for cancelling the shoot. The client acknowledges that weather variations may affect the final outcome, and any deposit paid serves as a reservation fee. Deposits are non-refundable in the event of cancellation due to cloudy weather conditions, as such circumstances are beyond our control.
In the rare event of extreme weather conditions, such as heavy rain, storms, or other unsafe conditions that make the photoshoot impossible, the shoot will be cancelled and the deposit will be fully refunded or rescheduled at the client’s request. These circumstances are considered force majeure and are beyond anyone’s control.

3. Photoshoot Details
The Photographer will provide guidance and assistance to the Client in selecting the optimal time slot for the photoshoot, taking into consideration the location and the desired effect the Client wishes to achieve in the pictures. Factors such as lighting conditions, weather, and the ambiance of the photoshoot location will be considered in determining the best time for the session. 

The Photographer will collaborate with the Client to schedule the photoshoot at a time that maximizes the potential for capturing desired outcomes. The final decision regarding the timing of the photoshoot will be made jointly by the Photographer and the Client, with the Photographer providing professional recommendations based on their expertise. Any changes to the agreed-upon details must be communicated to the Photographer in advance. 

The duration of the photoshoot is as agreed upon at the time of booking. Additional time may be arranged, subject to availability and an additional fee. Any changes to the scheduled shooting time must be communicated to the photographer at least 2 hours prior to the start of the shoot and are subject to our availability. If the client arrives late or informs the photographer of a delay less than 2 hours before the shoot, the shoot will still end at the originally scheduled time. The duration of the delay will be deducted from the shoot, and the client acknowledges that this may affect the final outcome of the photos or films. Please be on time.

4. Copyright and Usage Rights: 
The Photographer retains copyright of all images taken during the photoshoot. The Client is granted personal usage rights to the images for non-commercial purposes only. The Client may not sell, publish, or otherwise distribute the images without the Photographer’s written consent.

Any publication of the images on the internet, including but not limited to social media platforms, websites, or blogs, must be accompanied by a credit to the Photographer. The credit should include a tag or link to one of the platforms:

The Client agrees to ensure that proper credit is given whenever the images are shared online, as outlined in this clause. Failure to provide appropriate credit may result in a breach of these terms and may require corrective action as determined by the Photographer.

5: Acceptance of Photographer’s Style:
The Client acknowledges that they have reviewed the Photographer’s and Videographer’s portfolio and accepts their style and artistic approach. While the Photographer and Videgographer will make reasonable efforts to accommodate specific preferences and requests, the Client understands that the final outcome of the images may reflect the Photographer’s unique style. Any specific requests regarding editing styles or techniques must be communicated to the Photographer prior to the photoshoot, and their feasibility will be assessed on a case-by-case basis.
The client is responsible for reviewing our portfolio, website, and social media to understand our style. All photos and films will reflect this established aesthetic, and the client agrees that this style is part of the service. Requests for a style that significantly deviates from our established approach may not be accommodated.

6. Image Delivery and Selection Process:
The Photographer will create a preview gallery containing unedited pictures from the photoshoot for the Client’s review and selection within 3 days from the photoshoot date. The Client will have a period of three (3) months from the date of receiving the preview gallery to choose the specific frames they wish to be edited. Upon receipt of the Client’s selection, the Photographer will commence editing the chosen images. The delivery timeline for edited images depends on the package and is counted from the date the Client submits their selection to the Photographer. Any delays in the selection process by the Client may impact the overall delivery timeline.

The client has the right to select which photos will be edited. It is the client’s decision whether to make this selection themselves or delegate the choice to the photographer. If the client delegates the selection to the photographer, the photographer will choose the final images according to professional standards and artistic judgment. The client acknowledges that the photographer’s selection is final and cannot be contested.

Similarly, the photographer will offer the client the option to select the music for the video. If the client chooses to leave the music selection to the photographer, the photographer’s choice is final, and no changes or revisions will be made afterward.

The photographer do not provide RAW files or unprocessed JPEGs to clients. The only files delivered are carefully selected and edited photographs, chosen by the Client from the previews provided. These final images are professionally processed to meet Photographer’s quality standards. By booking our services, the Client acknowledges and agrees to receive only these edited, final photographs, with no access to unedited material or RAW files. This ensures consistency, artistic integrity, and alignment with the visual style of the Photographer.
All final images are delivered as digital files only. Printed photos, albums, or other physical products are not included unless explicitly agreed upon in writing prior to the photoshoot.

7. File Storage and Access:

All files will be made available to the client online for a period of 10 days. It is the client’s responsibility to download the files within this timeframe. If the client does not download the files within the 10-day period, they may request the photographer to resend them. However, the photographer is not obligated to store or maintain files beyond the original access period.

8. Client Cooperation: 
The Client agrees to cooperate with the Photographer to ensure the success of the photoshoot. Any delays or disruptions caused by the Client may impact the quality and duration of the photoshoot. The Client confirms that they will attend the photoshoot sober and not under the influence of alcohol, drugs, or any other substances that may affect their behavior, safety, or cooperation during the shoot. The Photographer reserves the right to pause or cancel the photoshoot if this condition is not met, without obligation to reschedule or refund. 

If, in our professional judgment, the client has unrealistic expectations regarding the outcome or requests that are incompatible with our established style, we reserve the right to cancel the shoot.
Additionally, if the client behaves in a disrespectful, disruptive, or unsafe manner, we reserve the right to terminate the photoshoot immediately. In such cases, any deposits or payments made will not be refunded.

9. Liability:
The Photographer will not be liable for any injury, damage, or loss to persons or property during the photoshoot. The Client is responsible for their own safety and that of any individuals accompanying them during the photoshoot.

10. Refund Policy for Bad Weather: 
In the event of inclement weather that renders the photoshoot impractical or unsafe, the booking fee will be fully refunded to the Client. The decision to cancel the photoshoot due to adverse weather conditions will be made jointly by the Photographer and the Client, taking into consideration factors such as safety, visibility, and feasibility of capturing desired outcomes. The Photographer will make reasonable efforts to provide alternative dates or times for rescheduling the photoshoot, subject to availability and mutual agreement. If a suitable alternative cannot be arranged, the booking fee will be promptly refunded to the Client via the original payment method. The refund of the booking fee constitutes the sole remedy available to the Client in the event of a photoshoot cancellation due to bad weather.

11. Model Release: 
The Client grants permission for the Photographer to use images from the photoshoot for promotional purposes, unless otherwise specified in writing. Any requests for privacy or restrictions on image usage must be communicated to the Photographer in advance.

12. Notification of Hotel Management (Private Area Photoshoots):
If the photoshoot is scheduled to take place in a private area of a hotel or resort, the Client is responsible for informing the management of the establishment in advance. The Client must obtain any necessary permissions or permits required by the hotel or resort for conducting the photoshoot in their premises. Any fees or charges imposed by the hotel or resort for the photoshoot, including but not limited to location fees or security deposits, are the responsibility of the Client and must be settled directly with the hotel or resort management. 

The Photographer will cooperate with the Client in providing any documentation or information required by the hotel or resort management for the photoshoot.

13. Modification of Pictures:
The Client is not permitted to modify, edit, or alter the pictures provided by the Photographer in any way. This includes but is not limited to cropping, adding filters, text overlays, or any other form of digital manipulation. The Client agrees to use the pictures as delivered by the Photographer without any modifications, except with prior written consent from the Photographer. 

 Any unauthorized modifications to the pictures may constitute a breach of copyright and may result in legal action.
